The use of photographs on websites continues to be an issue. According to trade press reports, lawsuits were filed against two broadcasters for the unauthorized use of photos on websites, though one suit was quickly dismissed as the named broadcaster in fact had purchased rights to the photos through Getty Images , a clearance house for the rights to use photographic images.

T oday, the Sabin Center for Climate Change Law is releasing a set of model protocols for assessing the impacts of climate change on the built environment under the National Environmental Policy Act (NEPA) and state equivalents. The protocols are intended for use in environmental reviews of proposed buildings and infrastructure (we plan to initiate a similar project for natural resource and land management projects in the near future).

'Last week, I listened in to presentation by RAIN News providing an excellent overview of the digital music industry (their Whitepaper setting out the findings reported during the presentation is available here ). One statement in that presentation suggested to me today’s topic – the use of music in podcasts. 'Could the Copyright Office become an independent agency with rulemaking power? Congress is examining all phases of copyright law, as well as the functioning of the Copyright Office. In connection with that review, the Register of Copyrights Maria Pallante (the head of the Copyright Office) sent a letter to John Conyers, the Ranking Member of the House Judiciary Committee, explaining her views on this topic.

One million dollars is still a big fine, even though the FCC has been handing out fines for that amount, or more, many times in recent months. But fines rarely hit these levels for broadcasters. But, yesterday, the FCC issued such a fine – hitting iHeart Media with a $1 Million fine as part of a Consent Decree imposed for the inappropriate use of EAS tones in the Bobby Bones syndicated radio program.

The FCC yesterday issued a Public Notice announcing its second EEO audit for 2015. Letters to just over 100 radio (no TV stations were included in the current audit) went out on June 12 asking for evidence of their compliance with the FCC’s EEO rules. Many of the stations included on this list appear to be noncommercial broadcasters. In yesterday’s notice, the FCC released the form audit letter and list of stations that will be audited.
