One of the threats faced by New York Gov. That is common in sexual harassment cases and hostile workplaces where you can get around statute of limitations when at least one case is recent or ongoing. The New York Penal Law focuses on “forcible touching” cases. Forcible touching is a class A misdemeanor.

In 2019, New York passed a bill eliminating both cash bail for most misdemeanors and non-violent felony offenses and judges’ discretion in setting bail amounts in those cases. In the last 17 months, 20 people have died in New York’s notorious jail facility on Rikers Island, the majority of whom were pre-trial detainees.

The late New York Gov. However, his son, Andrew Cuomo, the current New York governor, moved today from presumed sinner but presumed assaulter. Under federal law, the statute of limitations is three years. Once again, the viability of such actions will depend on the statute of limitations.

I have been critical of the indictment, which is reportedly based on a highly dubious use of a New York misdemeanor charge to revise a long dormant federal election law charge. But the New York case would be easily dismissed outside of a jurisdiction like New York, where Bragg can count on highly motivated judges and jurors.

If there is an Ed Wood school of prosecution, Manhattan District Attorney Alvin Bragg could prove to be its most apt pupil. That, apparently, is left to the suspension of disbelief.
