The court found that Congress and the courts had long recognized EPA’s authority to regulate greenhouse gases from power plants under Section 111, and that the major questions doctrine did not apply to EPA’s identification of the “best system of emission reduction.” Finally, the D.C. Circuit vacated the ACE Rule and remanded to EPA.
