Louisiana judge temporarily blocks state’s abortion ban trigger laws

Orleans Parish Civil District Court Judge Robin Giarrusso issued a temporary order Monday blocking Louisiana’s abortion ban trigger laws from going into effect. The decision comes as a result of the US Supreme Court’s controversial Dobbs v. Jackson Women’s Health Center, which held that abortion is not a constitutional right.

The order came in response to Hope Medical Group for Women v. Louisiana, a case filed in Louisiana by Hope Medical Group for Women (one of only 3 abortion providers the state) and the Center for Reproductive Rights (CRR). The CRR celebrated the order for emergency relief, saying “[a]bortion care is resuming in Louisiana.”

Louisiana is one of thirteen states with trigger laws and is expected to be one of twenty-three that ban abortion in some form. Kathaleen Pittman, the Administrator of the Hope Medical Group for Women stated:

Seeking reproductive care is already difficult in the U.S., and especially in Louisiana. Now, as state governments are trying to ban abortion throughout the country, including in Louisiana, my heart is with our patients whose entire lives and future may change based on the next few days. We are committed to this monumental legal challenge – not to perpetuate an endless political battle, but to ensure our patients’ wellbeing and so that they may draw strength from our dedication to this fight.

Louisiana Attorney General Jeff Landry has responded to this and other challenges to the state’s trigger laws by saying, “[t]hose who want to fight Louisiana abortion laws are in for a rough fight.”

Judge Giarusso has scheduled a hearing for July 8 to determine whether to continue the order.
