Fifth Circuit holds SEC in-house adjudicatory process violates right to jury trial

The US Court of Appeals for the Fifth Circuit Wednesday held that the Security and Exchange Commission’s (SEC) in-house adjudication violated the petitioner hedge fund manager’s Seventh Amendment right to a jury trial. The court found that Congress unconstitutionally delegated too much power to the SEC and statutory removal of in-house judges used in the adjudicatory process is unconstitutional.

US District Judge Lawrence Piersol ruled Tuesday that two South Dakota Sioux tribes have standing in a lawsuit against South Dakota over alleged National Voter Registration Act of 1993 (NVRA) violations. British police Thursday announced an end to their investigation of UK Prime Minister Boris Johnson for alleged violations of COVID-19 lockdown restrictions throughout 2020 and 2021. According to a press release from the Metropolitan Police, no further fines would be issued against Johnson or his wife. The press release stated that 53 fixed penalty notices (FPNs) were issued to 35 men and 73 FPNs to 48 women, for a total of 126 FPNs throughout the investigation.
