July 2017 Updates to the Climate Case Charts

Circuit Court of Appeals ruled that the U.S. Circuit concluded that the administrative stay constituted reviewable final agency action because it was consummation of EPA’s decision-making process with respect to the standards’ effective date even though EPA’s underlying decision to reconsider portions of the standards would not by itself be subject to review. The court therefore found that the stay was unauthorized and vacated it.

Federal Court Denied Oakland and San Francisco Motions to Return Climate Change Nuisance Cases to State Court; Found Federal Common Law of Nuisance Could Apply, Despite AEP v. The federal district court for the Northern District of California denied Oakland’s and San Francisco’s motions to remand their climate change public nuisance lawsuits against five major fossil fuel producers to state court. The court said defendants had not waived this issue.
