Should Joe Biden Be Banned?

Below is my column in The Messenger on the view of diplomats in the Biden Administration that the President is spreading “misinformation.” My interest in the story is less the merits than the allegation. The President is facing the same allegation of ignoring fact and spreading disinformation that has resulted in thousands being banned or blacklisted on social media. The Biden Administration has pushed for such censorship in areas where doctors and pundits held opposing views on subjects ranging from Covid-19 to climate control. The question is whether Joe Biden himself should be banned under the standards promulgated by his own Administration.

Here is the column:

An internal State Department dissent memo was leaked this past week, opposing the Biden administration’s position on the war between Israel and Hamas. What was most notable about the memo is that some administration staffers accused President Joe Biden of “spreading misinformation.”

It was a moment of crushing irony for some of us who have written and testified against the Biden administration’s censorship efforts. The question is whether, under the administration’s own standards, President Biden should now be banned or blacklisted to protect what his administration has called our “cognitive infrastructure.”

For years, the administration and many Democrats in Congress have resisted every effort to expose the sprawling government censorship program that one federal judge described as an “Orwellian ‘Ministry of Truth.'” As I have written previously, it included grants to academic and third-party organizations to create a global system of blacklists and to pressure advertisers to withdraw support from conservative sites.

Most recently, a House Judiciary Committee report revealed another layer of this system, described as a “switchboarding” role for the censorship system by channeling demands for removal or bans from state and local officials. This switchboarding process was confirmed by Brian Scully of the Department of Homeland Security’s Cybersecurity and Infrastructure Security Agency (CISA), during prior court testimony. CISA’s director, Jen Easterly, previously declared the administration’s intent to extend its role over maintaining critical infrastructure to include “our cognitive infrastructure” and combating not just mis- and disinformation but also “malinformation,” which CISA describes as “based on fact, but used out of context to mislead, harm, or manipulate.”

As a result, over the last four years, researchers, politicians, and even satirical sites have been banned or blacklisted for offering dissenting views of COVID measures, climate change, gender identity or social justice, according to the House Judiciary report. No level of censorship seemed to be sufficient for President Biden, who once claimed that social media companies were “killing people” by not silencing more dissenting voices.

Now, though, President Biden himself is accused — by some in his own administration — of spreading misinformation and supporting war criminals.

The five-page State Department memo was signed by 100 State and U.S. Agency for International Development (USAID) employees and was accompanied by a social media post by a junior foreign affairs staffer, accusing Biden of being “complicit in genocide” in Gaza. The memo accuses Biden of “spreading misinformation,” citing his Oct. 10 speech supporting Israel, and accuses Israel of committing “war crimes and/or crimes against humanity under international law.” It also accuses Biden of ignoring facts — a classic justification for past administration demands to censor figures — on the number of Palestinian casualties.

Democrats face a nightmare of allegations of disinformation on both sides of the war and other issues. Rep. Rashida Tlaib (D-Mich.) and numerous media outlets have been accused of spreading disinformation about Israel killing hundreds with an airstrike on a Gaza hospitalFormer CIA director Leon Panetta, in an interview on Fox News, stood by disproven claims about Russia faking Hunter Biden’s laptop.

There is, of course, not even a whisper (let alone a loud demand) for censorship or suspension of any of these figures or outlets, because that is not how the administration’s policies over “misinformation, disinformation, and malinformation” — what it terms “MDM” — work. The administration at one point insisted that it would police this “MDM space” to target views on a sweeping range of subjects, including racial justice and the disastrous withdrawal from Afghanistan.

So what will the Biden MDM space-rangers do with President Biden?

The obvious answer is, “Nothing.”

The administration can note that the memo’s view of war crimes is a minority position and a matter of opinion — although that hasn’t stopped others from being censored, particularly scientists involved in the COVID controversies, according to the House Judiciary report.

Indeed, under its own standards, CISA and other agencies may be confused who to censor. It has created standards so ill-defined that it is surrounded by actionable disinformation. For example, if the administration does not believe Israel is committing war crimes, should it push to censor its own dissenting diplomats?

The censors in the administration and at social media companies have always adopted vague standards that allowed them to pick and choose who should be heard or silenced. Former Twitter executive Anika Collier Navaroli called it a “nuanced” approach in determining how much free speech to allow; former CEO Parag Agrawal said that the “focus [is] less on thinking about free speech” because it is not on who should speak but “who can be heard.”

That leaves any potential censorship based on the ridiculous standard which Supreme Court Justice Potter Stewart advanced for pornography in the case of Jacobellis v. Ohio, 378 U.S. 184 (1964): “I shall not today attempt further to define [it] … But I know it when I see it.”

Thus, President Biden has no fear about his views being censored: His administration has always exhibited distinct myopia when it claims to know disinformation when it sees it.

    Parts of the deep state, to borrow a phrase, are revolting in opposition to his support for Israel against the Hamas terrorists responsible for the Oct. 7 massacre.

    News reports say that no fewer than 500 appointees and staff from 40 agencies, including the National Security Council and the Justice Department, have sent Mr. Biden a letter demanding that he call for a cease-fire and “de-escalation” between Israel and Hamas: “Americans do not want the U.S. military to be drawn into another costly and senseless war in the Middle East.” The signatories are bravely anonymous.

    The same is true of more than 1,000 employees at the U.S. Agency for International Development, who have reportedly signed a similar letter. “We believe,” it says, “that further catastrophic loss of human life can only be avoided if the United States Government calls for an immediate ceasefire in Gaza.” The letter adds that its backers are withholding their names out of “concern for our personal safety and risk of potentially losing our jobs.”

    If democracy means anything, perhaps they should lose their jobs or, better yet, they should resign honorably if they can no longer support the boss’s agenda. The malcontents are a sliver of the federal workforce. Yet the job of the executive branch is to implement a President’s policies, not run a pressure campaign to change them via anonymous letters and leaks.

    California Professor Arrested on Manslaughter Charges in Pro-Israel Demonstrator’s Death

    Loay Alnaji, a computer science professor at Ventura County Community College, was arrested Thursday morning and charged with involuntary manslaughter after he was involved in a deadly confrontation with pro-Israel demonstrator Paul Kessler.

    In early November, Kessler died of his wounds following “a physical altercation with counter-protestor(s),” in Los Angeles, the Ventura County Sheriff’s Department said in a statement afterward. “During the altercation, Kessler fell backward and struck his head on the ground. The Ventura County Medical Examiner’s Office determined the cause of death to be blunt force head injury and the manner of death homicide,” the statement continued.

    At the time of the incident, an unnamed suspect, since identified Alnaji, was detained by police as law enforcement conducted a home search before releasing the suspect on his own accord. Ventura County sheriff Jim Fryhoff told reporters shortly after that Alnaji was cooperative with authorities, though police refrained from publicly disclosing his name until a more thorough investigation was conducted.

    The Jewish Federation of Greater Los Angeles issued a statement in response to Kessler’s death, insisting that he was assaulted with a megaphone by a pro-Palestinian protester.

A jury has rejected the defense strategy that team Trump has been banking on using (for GA and J6 trials): “You’re free to believe what you want to believe, and what scarce freedom does that signify if you cannot then act on your beliefs?”

    The jury didn’t buy DePape’s defense that he thought at the time he was doing right by the country (to kidnap a Constitutional Officer, and pulverize her kneecaps unless she confessed). This verdict is a sober dose of reality for the chastened DePape, and the anarchist-malcontent tech-savvy zealots who fed his inbox and browser with clever psyOps. And, to DC insiders like Antony Blinken & Mike Morell, I convey the exact same warning: We the still-hinged and sober-minded citizens are seriously looking for a Constitutionally-sound way to shut your knowing, conniving falsehoods out of the political infospace. It would likely be based on suing you in civil court for Public Frauds — trusting juries as finders-of-fact — and recognizing Courts with their evolved evidentiary rules (including subpoena) are the place where artful fabrications go to die.

    2. It is likely the Willis case – and possibly even Smith’s case will not even make it to trial.

      A different case will go to trial in GA starting in Decemeber.
      In that case Raffensberger is the DEFENDANT and the allegations are that Raffensberger has corrupted the GA election process as far back as 2017. At issue is failures to properly certify electronic voting machines for SEVERAL ELECTIONS.
      And gross failure to follow GA law regarding signature vertification.

      Raffensberger tried to get the case dismissed. The Judge issued a 170+ page opinion citing the evidence rejecting Raffensberger’s motion and
      allowing trial to start in January.

      So immediately preceding the Trump cae – if the Trump case even manages to go forward will be the State of GA and specifically Raffnsberger getting the pants pulled down in public over failure to follow GA election law and failure to protect the integrity of the GA elections.
      Not for 2020, but for every GA election since 2017.

      The plantiffs in this case do not need to win to end the case against Trump.

      All they have to do is expose the serious problems with elections in GA.

      But it is near certain they will win on Signature verification atleast – I am not familiar with the details regarding problems with the voting equipment in GA. Only that Raffensberger refused to impliment a system of random audits to ensure the integrity of electronic voting machines, that I beleive was required by GA law.

      With respect to Signature verification – GA requires two factor authentication of all absentee ballots. That means an actual signature match which GA did not do, as well as either a Drivers liscence or SS# which GA did not do.

      A post 2020 random audit of mailin ballots in Cobb county – not the county Trump asked for an audit of,
      Found that 6% of ballots did not match the relaxed standards that Raffensberger imposed by fiat in 2020 – likely far more would not have met the actual standard of GA law. and 0.6% of the mailing ballots audited were refered to GBI as likely fraud.
      Trump lost GA by 0.26% of less than half of the fraud rate from the random audit.

      This random audit was small – only 5000 ballots. It also was conducted in an afluent Democratic county where the likelyhood of ballot Fraud was small. No one has been claiming that election results from Cobb County are suspect. The epicenter of GA fraud is Fulton county – Atlanta.

      After the results from Cobb County Raffensberger refused to conduct additional audits. God forbid that the Cobb county results were repeated successfully – Trump would have a credible claim that the election was stolen. Worse still and audit of Fulton county could have exposed much larger actual election fraud.

      Before it was shutdown because problems with the Fulton County count were surfacing, The third party lawsuit in GA was finding hundreds of duplicate ballots scans that were counted. But as the evidence of serious problems in Fulton county mounted the democrat judge reversed himself and decided the plantiffs did not have standing.

      I beleive at this time it is no longer possible to conduct further examination of the 2020 election as the records were all destroyed before the 2022 election.

      I do not know the details of this particular case – but it likely has the support of GA republicans and the legislature – as Willis is going after more than Trump, she is after many important GA republicans, and it is in their interest to end Willis.
      GA Republicans have been reluctant to end Willis’s witch hunt by Fiat – which they have the power to do.

      But I am sure that they will be happy to do so by destroying her case. Especially as she is not only targeting Trump, but targeting many of them.

      Raffensberger is not especially popular with Republicans in GA.
      And Kemp has been playing a very delicate balancing game.
      GA today is a purple state. He needs both the support of Trump, and the support of moderates to win.

      Kemp has been striving to distance himself from Trump, while at the same time disempowering the left wing nuts in GA.

Menendez, has just announced he will not run for re-election. This comes after after a House Ethics Committee found Santos had committed a number of crimes. But the House Republicans won’t expel Santos. That’s because Speaker Mike Johnson needs every vote he can get. Talk about duplicity!

      While there is noevidence at all of actual right wing motivated violence outside those who are mentally unhealthy.

      There is LOTS of left wing motivated political violence – even ORGANIZED left wing motivated political violence.

      The KKK and white supremecists groups have not engaged in political violence since the 70’s.

      Violence from neo-nazis today is domestic violence or conflicts between gangs over drugs or power.

      Conversely Antifa OPENLY espouses political violence.

      BLM does not espouse violence – but violence follows them where ever they go.

      There was over $2B in damage from BLM riots in 2020. There were dozens od people murdered – including police, and far more civilians.
      These as not crimes by drug adicts, alcoholics, the homeless, mentally ill people.

      These are deliberate crimes committed by people with political intentions.
      These are the modern equivalents of the Weather underground.

      More recently a hate crimes targeting Jews have increased 400%. Prior to that hate crimes targeting jews represented a plurality of all hate crimes. Now they are the majority by far. I beleive those targeting Asians are the next more common. Those targeting Blacks, gays. trans, are not only down, but the rate of violent crime involving trans people is 1/2 that of the nation as a whole. Despite propoganda Trans people today are SAFER than the rest of us.

      And who is committing these hate crimes ? The recent murder of a jew at the Gal Godot screening was by a college professor.
      There are no extreme right college professors. In fact a significant portion of hate crimes today are committed by minority college professors.

      While hate crimes – particularly those targeting jews have been on the rise – so has hate crime Fraud – think Jusse Smolet – only far more than that. Again these frauds are nearly always committed by left wing nut minorities.
