The President Who Stares at Goats: The Biden Administration Struggles with Minds over Markets

In Jon Ronson’s book “Men Who Stare at Goats,” one member of a wacky new Age, unconventional warfare unit explains,  “we are trying to make the world a better place by having people jump around, screaming ‘Hoo-ah!'”

The book (and later hilarious movie) came to mind this week as various Biden Administration efforts to shape the market (and consumer choices) have collided with economic reality. President Biden looks more and more like the President who stares at goats trying to prove the power of mind over markets.

This month, the Administration has doubled down on grants for electric vehicles while pushing manufacturers to go electric. However, Ford is cutting production and laying off workers because of the lack of demand. Dealers are revolting as their lots are filling up with electric vehicles that no one wants.

This week, the Administration was embarrassed when energy developer Orsted withdrew from agreements with the State of Maryland to develop two offshore wind projects. The reason? The wind projects are simply not profitable despite the push for the Skipjack Wind 1 and Skipjack Wind 2 projects.

Federal and state pushes for all electric mass transportation fleets have also lead to problems. Cities like Asheville, North Carolina spent millions to buy more expensive electric buses only to find that they have to be recharged every 70 miles. Three out of five buses are now broken and cannot be repaired because the company that makes the buses has filed for bankruptcy.

Politicians have long sought to shape consumer demands or markets by sheer will . . . and billions of dollars. It has largely failed on a spectacular scale. However, they are rarely blamed when these bills come due years later without results. For example, the Obama Administration touted its investment in solar panels with a massive half billion dollar subsidy for Solyndra. After the photo ops with President Barack Obama, Solyndra would later collapse as did another government-subsidized company.

In his 1960 paper, Ronald Coase wrote his famous work “The Problem of Social Cost.” The work, associated with what became known as the Coase Theorem, argued, among other things, that, in a perfect market, it does not matter which party has an “entitlement” or legal advantage. The more valuable resource or product will prevail. For example, in his famous hypothetical involving a conflict between a rancher and a farmer, it did not matter (absent “transaction costs”) whether a state favored farmers or ranchers. The entitlement of the state only impacted the distribution of wealth, not the ultimate allocation of resources. The market would determine what is more valuable: cattle or crops.

There are many elements at work in these non-perfect markets. However, the general thrust of Coase is still relevant. Consumers drive market choices, not entitlements or subsidies. Federal subsidy programs are often as effective as yelling at a storm to stop it. President Biden is yelling at the market to go green, but the supply and demand elements are not yet present to make that a reality.

Nevertheless, the Biden Administration continues to try to manipulate the markets. Take the decision this week by Biden to halt natural gas export facilities on climate change grounds. Allies in Europe need increased natural gas exports to reduce their dependency on Russia. They are effectively funding the Ukrainian war on both sides by aiding Ukraine while buying Russian gas. The problem is that Europe, which has embraced green energy, has found that it cannot sustain their populations or industry. The question is whether reducing exports will change that equation. Europe wants to go green, but it is likely to simply turn to Russia for the cheaper energy source.

None of this computes with those gluing themselves to rare paintings. The fact is that most of us are concerned with climate change and support efforts to reduce carbon pollutants.  Moreover, consumers have no yen for fossil fuels. If the cost and convenience of electric cars improves, the market will likely shift. However, politicians trying to pick winners among technology rivals has rarely worked economically. Yet, it has worked politically. No one, including Obama, faced repercussions for disasters like Solyndra and other companies. Photo ops were held, billions spent, and virtues signaled . . .  and the public was left holding the bag

Despite the recent denial of Energy Secretary Jennifer Granholm, President Biden once promised “I want you to look at my eyes. I guarantee you. I guarantee you. We’re going to end fossil fuel.” It is just a matter of focus of mind over markets.

As you look into his eyes, just remember, as Ronson wrote, “we are not just soldiers, we are men who stare at goats.”

  1. A couple of thoughts:

    Depending on your definition, the first “motorized car” could be said to have appeared anywhere between 1769 and 1886. No one would dispute that the changes in manufacturing methods and technology have vastly improved over the original design and have brought us to the point of having reliable and relatively cost-effective transportation and, in addition, mass transportation of goods. It’s conceivable that in the same timespan of 300 or so years, EV’s may reach the same relative position to their current iteration that the modern car is to the early steam-driven vehicle; but we ain’t there yet.

    The next thought ties to this (maybe tangentially). Those of us that are old enough to remember the Betamax versus VHS wars saw what happened when the technologically superior Betamax (better picture quality, better audio quality, more durable) lost out to VHS primarily because of lower cost and a longer recording time, leading to wider availability and higher demand – simply put, the market liked VHS better.

    At some point, EVs may well win out over ICE vehicles, but we ain’t there yet and won’t be until the market sees a reason to make it happen.

  2. Since all of us claim to support free market competition, this concept only works if we include all costs in the use of fossil fuels.

    Even conservative economists agree that gasoline would cost double it’s current price if we included all of the pollution costs.

    For example: if you have smog in big cities like NYC or Los Angeles that causes lung cancers, asthma or acid rain (polluting drinking water) – that cost is not included in the pump price of gasoline. If smog was removed from those cities, those cancers and illnesses would not exist.

    Private citizens/consumers still pay those costs omitted from the free market price, it it creates a false comparison to cleaner energy sources. So free market competition can’t incentivize cleaner alternatives.

    It appears the fossil fuel industry has no intention of a net-zero future or they would gradually add these hidden taxes to the retail price of their products to make the free market function properly.

  3. Pickup truck manufacturers – especially all electric pickups – are not selling due to excessive inflation on the price of pickup trucks over 20 years. Not lack of demand for all electrics.

    This excessive pickup truck inflation – over 20 years – can’t be blamed on Covid and lack of demand. Most us just wish our paychecks inflated enough to buy an all electric or hybrid pickup truck.

  4. While Turley rages on about Americans who buy Elon Musk Teslas & other EV’s, he deliberately avoids this economic reality: the US now produces a record 13.5 million barrels of oil per day. Yep, Professor, with Biden in the White House, the US now produces more oil than any other country in history.

    I live in California. Last week, I paid $3.57 a gallon for gas. Two years ago, gas here was $6 a gallon. I now pay $30 less when I fill up my tank compared to a couple years ago.

    Turley has repeatedly called Biden a gaffe machine, yet now singles out a single comment he made about ending fossil fuel. Trump repeatedly pledged to repeal Obamacare, build a wall and make Mexico pay for it, and, get this, solemnly vowed that he would eliminate the national debt in 8 years. Instead, he added $7.9 trillion to the debt.

    Yet Turley insists Biden’s single comment about fossil fuels is far more significant than the fact that American consumers are now greatly benefiting from plummeting prices at the pump and the US now has record oil production with Biden in the White House.

      Yesterday, the California average for regular was $4.50/gallon. Last year, it was $4.50/gallon.

      In 2019, it was $3.13/gallon.

      1. Sam, your numbers check out with our prices here. Not the exact same prices, but the ups and downs and spreads check out.
        The California numbers are made up.

      2. It is. My wife’s fam is in CA, and if someone is paying less than $4/gallon, I’d sure love to know where they live. In my in-laws hometown, and it’s a conservative county (as far as that goes in CA), gas is $4.59+/gallon, and that is if you pay with cash and avoid card fees. For ‘fancy’ gas, you are paying upwards of five bucks a gallon. Today. That person is lying through their teeth. Gas is not that cheap anywhere in the state of CA. Period. Lies, lies, lies. I’ll post a picture if you want.

        1. Well, James, since you asked so nicely, gas is $3.67 a gallon at Costco in Palm Desert. At the Palm Desert Sam’s Club, it’s $3.62 a gallon. And as I mentioned, I paid $3.57 a gallon at the Aqua Caliente station in Rancho Mirage.

            So your initial comment was a lie by omission — and gave cherry picking a bad name. Imagine that.

            Costco gas is always about .25$/gallon cheaper than other local prices because it’s a hook to get people into their stores. (Ditto for Sam’s Club.) And buying their gas requires a *paid* membership. Incidentally, if you had been honest you would’ve noted that *Costco* gas elsewhere in California is some $4.30/gallon.

      3. I paid $3.57 a gallon at the Aqua Caliente gas station in Rancho Mirage, Sam. You seem to have a little trouble understanding that an average price of $4.50 a gallon doesn’t mean that’s the price every gas station charges. The nearest Shell station sells gas for $4.55 a gallon. It’s rather amazing how some people in my city will pay $4.55 a gallon gas when they can get it for $3.57 a gallon, but that’s not my problem.

        As to the accuracy of our country now having record oil production & the US now producing more oil than any other country in history, I respectfully suggest you take a few moments to further research that. You will discover the US now produces 13. 2 million barrels of oil per day. Trump’s highest total was 13 millions of oil per day. It’s not hard to figure out why the price of gas has dropped so much over the past 2 years.

    Let’s see:

    I can have a car that takes anywhere from 1/2 hour to 1/2 day to fill up. It’s range might be 300 miles or 200. I might, or might not, be able to find a filling station. That filling station might, or might not, be operational. My car might, or might not, work when it’s cold.

    Or I can have a car that takes about 10 minutes to fill up, anywhere in the country, any day of any season. Oh, and that same model car is significantly less expensive.

    1. EV sales have risen – but not much and 50% of the entire market is tesla

      No one besides Tesla has managed to sell more than 60,000 cars the entire year.
      Tesla sold a 800,000 EV’s last year. Ford – the largest competitor sold 60,000 EVs.
      But Ford sold 2M Gas vehicles.
      Going from 10,000 Q1 to 20.,000 Q4 is a big jump. But it is TINY as part of the auto market.

    3. I’ve always ‘loved’ statistical abuse —— a rise in convention auto sales is a good sign — a rise of nearly 30% means sales rose from 100 vehicles to 130 vehicles….see what I mean?

  8. When I read the headline of Professor Turley’s article, it crossed my mind whether he was referencing Joe Biden and how he looks at his wife, Doktur Jill. Happily that wasn’t the case. Goats don’t plagiarize and are smart enough not to pursue an Ed.D. degree. That and their kids are useful, clean and sober.

  9. Jonathan: Alina Habba is not finished making a fool of herself. The ink on the jury verdict awarding E. Jean Carrol $83million in damages is hardly dry and Habba wrote a letter (1/29) to Judge Kaplan alleging he violated the cannons of judicial ethics because he had a “mentor-mentee” relationship with Roberta Kaplan (no relation) when they worked at the same big law firm back in the 1990s. And the source of Habba’s allegations? An article that appeared in Rupert Murdock’s salacious NY Post where you often publish articles. Habba is even quoted in the article. None of the allegations in the article are true.

    Today, Roberta Kaplan responded to Habba’s letter claiming there was never “mentor-mentee” relationship between herself and Judge Kaplan and asked the judge for sanctions against Habba. Barely 2 hours after Kaplan wrote her letter Habba now does an about face. In a follow up letter Habba now says it was just a big misunderstanding. That her letter did not to accuse Judge Kaplan of ethical violations (which it did) but “simply to inquire as to whether there is any merit” to the NY Post article. Now Habba wants the whole thing to go away because she has no “personal knowledge as to whether the information contained in the [NY Post] article is true or false”. Habba now says that “[s]ince Ms. Kaplan has now denied there was ever a mentor-mentee relationship between herself and your Honor, this issue has been resolved”.

    One person for whom the matter has not been “resolved” is Judge Kaplan. Judges take seriously false claims of ethical violations. So I would expect Judge Kaplan to haul Habba back into court and sanction her. Seems Alina Habba is radio-active–making filings based on spurious allegations in a Murdock tabloid. When will she learn? Probably never. Alina spends her time staring at goats–hoping they will just fall over dead. But Judge Kaplan is not a goat!

        There is an issue it APPEARS to be minor. But the issue STILL is with Kaplan and Kaplan – not Habba.
        They were required to disclose even potential conflicts.

        But it is also possible that Attny Kaplan is lying about the relationship.

    4. The Judge and the plantiffs lawyers were both at the same firm.
      Judge Kaplan has admitted that.
      At the bare minimum that was REQUIRED to be disclosed to the defense.

      There is no formal defintion of a mentor/mentee relationship.

      It is HOWEVER legitiamte for Habba to enquire as to the nature of the relations – not labels such as Mentor/Mentee,
      But how closely did Attny Kaplan and Judge Kaplan work.

      You are lobbing accusations – but the FACT is that particularly as the relationship was NOT disclosed.
      Habba has both the right and the obligation to inquire further.

      In fact it would actually be a professional error on Habbas part not to do so.

      If you wish you can pretend that Habba should have been more polite in her inquiries.
      But they were Required regardless.

      The Error here is on the part of Kaplan and Kaplan – not Habba.
      They failed to disclose the relationship.

      I would note conflicts are taken very seriously in law, law firms, and with respect to judges.
      It is REQUIRED that the attorneys and the judge on a case do a conflicts check at the start of the case.

      I would further note that Carrol is entitled to the lawyer of her choice – regardless of whether there is a conflict with the judge or with the opposing lawyer.
      Conversely Trump is entitled to the lawyer of his choice – regardless of whether there are conflicts.
      Where there is a conflict between the judge and the attorney’s – either all parties must waive the conflict AT THE START or the judge must recuse.

      When a judge takes office it is the norm for that judge to be recused from all cases from his former law firm for a significant period of time.

      From what I can tell Kaplan and Kaplan were at the same firm many years in the past.
      That still should have been disclosed to Trump no matter what,
      But it might not constitute a conflict that requires the Judge to recuse
      DEPENDING ON THE RELATIONSHIP.

      I have no idea whether Judge Kaplans claim that there was little relationship with Attny Kaplan is true.
      Law Frims come in a large variety of sizes and NY law firms can be extremely large.
      Judge Caplan is NOT obligated to recuse himself from cases where other lawers from his firm that he had limited relationships with are lawyers for one party or another. But the Judge and the attoney with the relationship ARE required to disclose.
      The duty probably is higher for Attny Kaplan that Judge Kaplan as conflict records are usually preseverved by Law Firms not Judicial chambers.

      regardless, you are making a big stink over alleged misconduct by Habba, when in fact the Error was by Kaplan and Kaplan.

      Judge Kaplan says the relationship was inconseuqntial – I do not trust him about anything for a second.
      But higher courts are likely to. Further if Judge Kaplan says the relationship is inconsequential and it is discovered to be false – that is a far more serious ethical violation than anything addressed so far.

      The only ethical violation in this thus Far is by Kaplan and Kaplan.

      I(F and Only If the relationship was inconsequential – then the violation is minor.

      You claim that Habba got this information from a new article, and that article incorrectly stated the nature of the relationship.

      SO WHAT ?

      It is not Habba’s duty to vet Judge Kaplan and attny Kaplan to see if they have Conflicts.
      That is knowledge that Attny Kaplan and Judge Kaplan have.

      We do not require the attorney’s in a case to discover if the judge has a conflict – That duty OBVIOUSLY belongs to the Judge.
      Even the monor conflict that attny Kaplan now claims existed – was REQUIRED to be disclosed.

      There is no “mentor/Mentee” standard – you are off on a wild goose chase there.
      There are an infinite variety of relationships that a judge can have with someone involved in a case.
      Some of those relationships are clear conflicts. Some are not, some fall into grey areas.
      That is why there is a duty to disclose.

      Trump is not supposed to have to rely on Habba to hire a private investigator, or to find out about relationships in the press.
      In the event she Does find out about them from some source other that the judge and the other attorney – the ethical problem associated with her making a false assumption rests with the party who failed to disclose.

      This is simple logic.

      Or would you prefer that we require each side to hire private investigators to dig into the lives and private lives of all the judges and attorny’s in a case.

      I would note – I said that Carrol can have whatever attorney she wishes – that is NOT without exception.
      If as an example Attny Kaplan had previously represented Trump – she could not work for a client adversarial to him.
      In fact the could not work for anyone else involved in the case – some cases have multiple parties, without Trump’s permission.

      Further Conflists are NOT limited to those between the judge and attornies.
      The relationship of the Judge with Kaplan, Carrol, any firm Kaplan worked for, Trump, Habba, any firm Habba worked for,
      As well as witnesses and all other parties in the case – any of this is supposed to be disclosed and could result in a requirement to recuse.

      Even if this turns out to be nothing – the error – though minor is Judge Kaplan and Attny Kaplans.
      They were the ones with the duty to disclose.

      But as is typical – you get all of this completely wrong.

      In all cases you assume the party in error in any conflict is the one you dislike the most.

      You have made all kinds of both false and defamatory claims regarding Habba – echoing people with poor credibility and knowledge of the case.

      As I pointed out to you – Habba’s assorted motions ALL prove the claim that Habba has not properly objected and therefore has no grounds to appeal. Everything in every motion by Habba is grounds for appeal.
      Whether it is winning grounds will be decided by the appeals courts – Not Judge Kaplan.

      The moment Habba appeals – Kaplan no longer has jurisdiction.

      This was also the reason that Judge Chutkan in DC ordered Smith to cease filing things in her court while the case was on appeal.
      She was way too polite to Smith, but she was opbligated to order him to stop.

      Smith was deliberately or ignoratnly making a first year law mistake.

      The case had been appealed – Two courts can not have jurisdiction of the same case at the same time.
      As the case was with the appleate court for the duration of the appeal, the case in DC was suspended until the appeal was final.
      Whild Chutkan ordered the case suspended and Smith violated that order.
      The fact is no order was needed and technically the order was invalid.
      The case is on appeal – Chutckan has no jurisdiction and Smith pretending otherwise is unethical.

      1. John Say: If I’m full of “Schiff” you are full of Alina Habba! You should read Habba’s letter of 1/29 to Judge Kaplan. Have you? The facts are that Judge Kaplan and Roberta Kaplan worked at the same 1000 person law firm back in the 1990s. Roberta was a jr. associate and Judge Kaplan was a senior partner. Judge Kaplan was never Roberta’s “mentor” nor did they work on any cases together.

        Habba bases her allegations solely on the allegations in the NY Post article–a fact free article that claimed the two were in a “mentor-mentee” relationship. There was no duty to disclose because there was no ethical violation. And, yes, Habba should have hired investigators to look into the NY Post charges before she wrote her letter.

        That’s why Habba is in deep trouble with Judge Kaplan. Despite your ridiculous claims the Judge still has jurisdiction over the case and can haul Alina back before him and impose sanctions!

Many people are mentors without even knowing it. “providing psychosocial support that includes role modeling, and offering career or instrumental support that includes providing challenging work toward skill development (Kram,K.     6. If Judge Kaplan hauls Habba back to court and sanctions her – that WILL be an ethical violation on his part that requires him to recuse.
      The obligation to disclose even potential conflicts rests with those who have the conflict – in this case Kaplan and Kaplan.
      The obligation exists even if the conflict is NOT sufficient to warrant recusal.
      The obbligation exist and belongs to the party with the conflcit specifically to AVOID problems like this.

      At is not only reasonable for Habba to raise the issue of an undeclared conflict when she becomes aware of it – it is her ethical duty.

      I do understand that you are getting confused by the massive amount of unethical conduct we are seeing by the Get Trump left wing nuts.

      Willis and Wade now have something like 7 or 8 different investigations into their conduct, Two judges, 2 atlanta county commissioners investigations, the GA house, the GA senate, and the US house of representatives. With possible Bar and GA AG investigations to come.
      The odds of Willis, Wade, the Atlanta DA’s office remaining on the case are slim.
      The odds of Willis being impeached are near certain, The odds of willis and wade going to jail are low but possible.

      Regardless what is occuring in GA alone should make you aware of the importance of disclosing potential conflicts.

      It was not Romans attorney’s obligation to discover the conflicts that Willis had.
      it was Willis’s obligation to disclose them.

      It is not Willis’s romantic relationship with Wade that is the problem – it is that she hired him – without third party approval, and that she paid him – without third party approval, and that she received things of value back from him.

      Had Willis disclose the relationship at the start – Wade would have been removed from the case and Willis could have proceeded.

      We are also now discovering that the Biden WH was communicating in secret with both Wade and Willis and that DOJ and the SC were also.

      That MAY not be illegal. But Willis has burned her credibility so that contact will be viewed differently because she has been caught hding things.

  11. OT, Covid as a weapon to be used against humans, for the profit of Pfizer and other Big Pharma players, was in development as far back as 1965. In the early 2000s, Fauci was instrumental in bringing it all to pass. It is a 100% human-engineered virus that could not possibly have come from a wet market.     Therefore since there is no doubt that free enterprise capitalism is superior in productive terms, the left-wing doxa has attacked capitalism, alleging matters of morality, saying – that’s what the detractors claim – that it’s unjust. They say that capitalism is evil because it’s individualistic and that collectivism is good because it’s altruistic. Of course, with the money of others.

    So they therefore advocate for social justice. But this concept, which in the developed world became fashionable in recent times, in my country has been a constant in political discourse for over 80 years. The problem is that social justice is not just, and it doesn’t contribute to general well-being.

    Quite on the contrary, it’s an intrinsically unfair idea because it’s violent. It’s unjust because the state is financed through tax and taxes are collected coercively. Or can any one of us say that we voluntarily pay taxes? This means that the state is financed through coercion and that the higher the tax burden, the higher the coercion and the lower the freedom.

          1. Trump is NOT”over50 percent” in the most- recent poll, contrary to what John Say claims, and is still behind Biden with the other candidates on the ballot. At least I cited my source, which John Say failed to do. What did I say that causes you to attack my credibility? My point is that Trump is NOT “over 50 percent“, which is true. Just like the alt-right media you rely on, you seem to have some pathological obsession with painting anyone you disagree with as a liar.

    Even if they are only marginally effective on a very small percentage of the global land mass, the wackjobs intend for the world to taste, smell, and look good in its casket, one presumes.

  17. It’s hard to believe that adults in America, and across the Earth do not remember the basic science of photosynthesis. A scientific fact that carbon dioxide is turned in oxygen by the very plants and trees destroyed to put up massive wind and solar farms. The Amazon jungle, Known as a “lung of the Earth,” is being destroyed for its balsa wood to make the blades for turbines. Such Eco destruction happening in the name of saving the environment.

    Since we know, photosynthesis gives us oxygen, would it be more intelligent and cost-effective to plant more trees and plants to increase photosynthesis to clean and beautify our environment?

      Note, only 10% of solar panels are recycled. Less than 5% of wind turbines are.
      The rest are landfill bound, NOT green or Eco-friedenly. Both have elements in them that are toxic that can and will leech into the local water table.
