Federal judge rules California ban on high-capacity gun magazines unconstitutional

A US district judge struck down on Friday a California ban limiting gun magazines to ten rounds. In the decision, US District Judge Roger Benitez stated that the state’s prohibition of high-capacity magazines was a violation of the US Constitution’s Second Amendment and “clearly unconstitutional.”

The US Court of Appeals for the Ninth Circuit Tuesday ruled 7-4 in favor of a California law banning high-capacity gun magazines. Bonta, concerns the importation, possession, and sale of magazines containing more than ten bullets. California Penal Code section 32310 prohibits possession of such high-capacity magazines.

US District Court Judge for the District of Oregon Karin Immergut ruled on Friday that Oregon Ballot Measure 114 (BM 114), which restricts large-capacity magazines (LCMs) and requires permits before purchasing a firearm, is constitutional. Current owners of 10-round magazines are exempt from the law. Police are exempt from the law.

The Vermont Supreme Court on Friday upheld a new state law prohibiting high-capacity magazines, affirming the validity of the state’s first major gun-control law. The law also sets limits for magazine sizes at 15 rounds for handguns and 10 rounds for long guns. The trial court denied his motion.
