Report reveals British Virgin Islands government corruption, suggests constitutional suspension

The British Virgin Islands (BVI) Commission of Inquiry Friday released a report suggesting that the BVI should temporarily suspend its constitution, dissolve its House of Assembly and be directly ruled by its Governor.

In January 2021, then-BVI Governor Augustus Jaspert issued an investigation into the governance of the territory, aiming to uncover “corruption, abuse of office and other serious dishonesty.” His successor, Governor John Rankin, took over the investigation and stated that the UK Government had an obligation to the citizens of the BVI. The inquiry reviewed allegations of government corruption and drug laundering. Governor Rankin said that, with the support of the UK Government, the investigation was to look at the “deteriorating state of governance in the British Virgin Islands, as well as the potential vulnerability of the island to serious organized crime.”

From increasing pressure on the UK to tackle drug trafficking in the territory, the 1000-page report identifies the gross maladministration to prevent corruption and drug-related crimes. It also revealed that there are fundamental flaws in the constitution, which will require a substantive legislative and constitutional change to rectify. The report commissioner, Sir Gary Hickinbottom, explained that “[a]lmost everywhere, the principles of good governance, such as openness, transparency and even the rule of law, are ignored” in the BVI government. Hickinbottom further noted: “With limited exceptions, in terms of governance . . . , the people of the BVI have been badly served in recent years. Very badly indeed. ”

The Ministers of Oversees Territories are set to speak to Governor Rankin next week to plan for a “clear path forward.” The report was made public following the arrest of elected leader Andrew Fahie for money laundering on Thursday.
