Today in Borden v. United States, No. 19-5410, Justice Elena Kagan announced the judgment of the Court and delivered an opinion in which Justices Stephen G. Breyer, Sonia Sotomayor, and Neil M. Gorsuch joined. Justice Clarence Thomas issued an opinion concurring in the judgment. And Justice Brett M. Kavanaugh issued a dissenting opinion, in which Chief Justice John G.
