Smith has a reputation in conservative circles for stretching the criminal code in high-profile cases, including the prosecution of then-Virginia Gov. However, relying on bad advice or bad law is not a crime. We have never criminalized such interpretations.

I do not view it that way, but I do believe Smith is showing his signature lack of restraint in high-profile cases, a tendency that led to the unanimous overturning of his conviction of former Virginia Republican Gov. There may be a judicial argument for gagging Trump, but it raises serious constitutional concerns. Robert McDonnell.
